1. Acceptance of Terms

By accessing or using SignalWalker ("the Application"), you agree to these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use the Application.

2. License Grant

Total Creations grants you a non-exclusive, non-transferable, revocable license to use SignalWalker for personal or business purposes, subject to these Terms and the End User License Agreement (EULA).

3. User Accounts

3.1 Registration

To use SignalWalker, you must create an account. You agree to:

• Provide accurate and complete information
• Keep your account information updated
• Maintain the security of your password
• Notify us immediately of any unauthorized use

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You may not share or sell your account to third parties.

4. Permitted Use

You may use the Application for:

• Task management and productivity enhancement
• Idea management and brainstorming
• Personal or business organization
• Collaboration with other users (if available)

5. Prohibited Activities

You may NOT use the Application for:

• Illegal or harmful purposes
• Violation of third-party rights
• Distribution of malware or harmful code
• Reverse engineering or decompiling the Application
• Automated access without permission (scraping, bots)
• Overloading or disrupting our servers
• Circumventing security measures
• Selling or commercial exploitation without permission

6. Subscriptions and Payments

6.1 Subscription Tiers

SignalWalker offers different subscription tiers:

• Free: Basic features with limitations
• Premium: Advanced features with monthly billing
• Lifetime: One-time payment for lifetime access

6.2 Payment Terms

• Payments are processed via Stripe
• Premium subscriptions renew automatically
• You can cancel your subscription at any time
• Refunds are issued according to our refund policy

6.3 Price Changes

We reserve the right to change prices. Existing subscribers will be notified at least 30 days in advance.

7. User-Generated Content

7.1 Your Ownership

You retain all rights to the content you create in SignalWalker (tasks, ideas, notes, etc.).

7.2 License to Us

You grant us a non-exclusive license to use your content to:

• Provide and improve the services
• Enable backups and recovery
• Provide technical support

7.3 Content Responsibility

You are solely responsible for the content you create. You may not upload illegal, offensive, or infringing content.

8. Intellectual Property

All content in SignalWalker, including but not limited to:

• Software and code
• Design and user interface
• Logos and trademarks
• Documentation and text

are the property of Total Creations and are protected by copyright and other intellectual property rights.

9. AI Features

SignalWalker uses AI services for various features:

• Audio-to-text transcription
• Auto-filling task fields
• Image generation for thumbnails

You acknowledge that AI-generated content may not be perfect and should be reviewed.

10. Privacy

Your use of SignalWalker is also governed by our Privacy Policy, which is part of these Terms.

11. Updates and Changes

We may update the Application from time to time to:

• Improve functionality
• Fix bugs
• Add new features
• Enhance security

These updates are provided at our discretion and may be required for continued use.

12. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES. WE DO NOT GUARANTEE THAT:

• The Application will function without errors or interruptions
• Errors will be corrected
• The Application is free of viruses or harmful code
• The results of using it will meet your expectations

13. Limitation of Liability

IN NO EVENT SHALL TOTAL CREATIONS BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of data or profits
• Business interruption
• Damages arising from the use or inability to use the Application

OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

14. Indemnification

You agree to indemnify Total Creations against any claims, damages, and costs arising from your use of the Application or violation of these Terms.

15. Termination

15.1 By You

You can terminate your account at any time by:

• Deleting your account in the settings
• Contacting us via email

15.2 By Us

We may terminate or suspend your account if:

• You violate these Terms
• We suspect illegal activities
• You fail to make payments
• We discontinue the service

15.3 Consequences of Termination

Upon termination, you will lose access to your account and your data. We may delete your data after a reasonable period.

16. Governing Law

These Terms are governed by German law. The place of jurisdiction is Bretten, Germany.

17. Dispute Resolution

In the event of disputes, both parties agree to first attempt an amicable settlement. If this is not possible, ordinary courts apply.

18. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Application. Continued use after such changes constitutes acceptance of the updated Terms.

If any provision of these Terms is found to be invalid, the remaining provisions shall remain unaffected.
